Covenant Violations

 

Procedures

Violations may be reported anonymously by any resident by phone or in writing. The alleged violation must then be independently confirmed by a WIA employee or the Director of Covenants (DC). Once a violation is confirmed the complainant is no longer involved, since the DC becomes the complaining party and the violation becomes a matter between the Association and the violating owner. Most violations trigger a warning notice to the violator, advising of the violation, stipulating a time during which the violation must be corrected, and the consequences of failing to act. In the case where a warning has gone unheeded beyond the established time limit, the owner will be advised of the right to appear at a hearing, at which a penalty may be imposed. Some violations, however, will initially trigger a hearing notice instead of a warning. For example, a violation which cannot be remedied, like unauthorized tree cutting, will result in a hearing, and violations which imperil resident safety, like a vicious dog or an open fire will likewise trigger an immediate hearing.

Hearings

Hearings are conducted privately by the WIA Board of Directors monthly, as needed. A hearing may result in the Board voting to dismiss the violation, or to impose a penalty, usually in the form of a monetary fine. If a violation is still not remedied after a hearing has been held, the violator may be subject to an additional or escalating fine or other penalty. Unpaid fines are enforced by placement of a property lien and, if necessary, collection or legal process.

Impact

The WIA receives numerous covenant complaints each week, most of which are subsequently confirmed to be violations. The majority of these are resolved by WIA first notice to the owner requesting compliance. In approximately 10% of the cases however, hearings are required to enforce our rules. This may result in the imposition of fines.  In Woodmoor our covenants ARE enforced, just as the price commanded for our homes today confirms the 30 year old reason for the covenants, "to protect the value & desirability" of Woodmoor!
