Solicitation

 

A common misconception in our community is that soliciting is not allowed in Woodmoor. Unfortunately, Woodmoor is not a private, gated community where the Association owns all the roads and land. Woodmoor is not considered, in general, to be private property because the roads that serve Woodmoor are owned and serviced by El Paso County. Therefore, the WIA is not permitted to prohibit soliciting.

In the past WIA has attempted to monitor solicitor activities and limit the hours solicitors could contact residents in Woodmoor, but we were advised by WIA legal counsel that this is a violation of a First Amendment right.

WPS does respond to resident complaints and attempt to make contact with solicitors to resolve any issues and get information in case problems come up later. If a solicitor leaves advertising materials on a property without contacting the owner or tenant, this can be considered littering on private property. If a solicitor refuses to leave after being advised by the owner or tenant to do so, then it becomes trespassing.

As in all cases, it is highly recommended that you check out the company before purchasing any goods or services with an agency such as the Better Business Bureau (www.bbb.com) or other reliable source for consumer complaints.
